WEBSITE PRIVACY POLICY & PAIA MANUAL
This website privacy policy describes how Ardhi process information we collect and/or receive from you.
1. INFORMATION ARDHI COLLECT AND RECEIVE
1.1. Ardhi collect and receive information about you in the following ways:
1.1.1. Information you supply us;
1.1.2. Information we collect or receive when you use our website or social media platforms;
1.1.3. Information from third-party sources.
2. INFORMATION YOU SUPPLY ARDHI
2.1. This includes any information that you provide to us directly:
2.1.1. when you sign-up to utilise Ardhi’s services;
2.1.2. by filling in forms on our websites, or those provided to you;
2.1.3. when you enter a competition, promotion or complete a survey;
2.1.4. by posting comments or content on our social media pages; or
2.1.5. when you contact us or we contact you and you provide information directly to us; and
2.1.6. when you register for an event
2.2. When you register to use Ardhi’s services, you may be required to provide us with the following information, namely your:
2.2.1. name and surname;
2.2.2. contact number and email address;
2.2.3. physical address;
2.2.4. payment details; when you make a purchase;
2.2.5. identity or passport number; and
2.2.6. date of birth.
3. INFORMATION ARDHI COLLECT OR RECEIVE WHEN YOU USE OUR WEBSITE OR SOCIAL MEDIA PLATFORMS
3.1. Ardhi collects information when you use websites or social media platforms by using cookies, web beacons and other technologies. Depending on how you access and use websites, we may receive:
3.1.1. Log information;
3.1.2. Information we infer about you based on your interaction with products and services;
3.1.3. Device information (for example the type of device you're using, how you access platforms, your browser or operating system and your Internet Protocol ("IP") address);
3.1.4. Location information.
4. INFORMATION COLLECTED FROM THIRD-PARTY SOURCES
4.1. Ardhi may receive additional information about you that is publicly or commercially available and combine that with the information we have collected or received about you in other ways or via other avenues.
5. HOW ARDHI USES THE INFORMATION COLLECTED AND RECEIVED
5.1. Ardhi uses the information we collect and receive for the following general purposes:
5.1.1. to provide you with information, products or services you request from us;
5.1.2. order processing;
5.1.3. in order to refer you to an appropriate third-party service provider;
5.1.4. to communicate with you;
5.1.5. to provide you with support; and
5.1.6. to provide effective advertising (for example to be provide you with news, special offers and general information about other goods, services and events which we offer, that are similar to those that you have already hired or enquired about).
6. HOW ARDHI SHARES THE INFORMATION COLLECTED AND RECEIVED
6.1. Ardhi doesn’t sell your personal information to third parties for their marketing purposes.
6.2. Ardhi may share information:
6.2.1. by disclosing your personal information to a limited number of Ardhi’s employees and third-party service providers;
6.2.2. to our business partners. Ardhi may share non-personally identifiable information with select business partners.
6.2.3. to other parties in response to legal process or when necessary to conduct or protect our legal rights;
6.2.4. to companies that provide services to us. Companies that provide services to us or act on our behalf may have access to information about you. These companies are limited in their ability to use information they receive in the course of providing services to us or you; and
6.2.5. to third parties where you provide consent. In some cases, third parties (often advertisers) may wish to attain information about you in order to promote their products to you, or for whatever other reason. Ardhi may share information with third parties where you provide consent in the form of an explicit opt-in. Before we ask you to opt-in, we will endeavour to provide you with a clear description of what personal information would be shared with the third-party. Remember that once you have opted in to allow us to send your information to the third-party, we cannot control what they do with your personal information; therefore, be sure to investigate their privacy policies before providing permission for us to share your information.
7. DATA SECURITY
7.1. Your payment information is encrypted and transmitted securely using SSL (Secure Socket Layer) technology.
7.2. Your financial information is never taken by us either through our website or otherwise. At the point of payment, you are transferred to a secure page on the website of some reputable service provider. That page is not controlled by Ardhi. Ardhi’s employees and contractors have access to limited transaction information, but the majority of this data, including card information, is hidden from us.
7.3. You remain responsible for maintaining the confidentiality of your account information, and we encourage you to create a strong, unique password.
8. YOUR RIGHTS
8.1. You have the right to ask Ardhi not to contact you for marketing purposes. You can exercise this right at any time by using any of the various "opt-out" options that we will always provide to you when we communicate with you. Ardhi won’t send you marketing messages if you tell us not to, but we will still need to send you service-related messages.
8.2. Ardhi’s website uses cookies. If you wish to reject our cookies, you can configure your browser to do so.
8.3. Ardhi wants to make sure that any personal information we hold about you is up to date. Should you believe that your personal information is inaccurate, please ask is to correct or remove it.
9. RETENTION OF PERSONAL INFORMATION
9.1. Ardhi will retain your personal information only for as long as is necessary for the purposes set out in this privacy policy or to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.
10. ARDHI’S COMMITMENT TO SECURITY
10.1. The security of your personal information is important to Ardhi. While Ardhi strives to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
10.2. Ardhi does employ several safeguards intended to mitigate the risk of unauthorized access or disclosure of your information.
10.3. Ardhi will do our best to protect your personal information and we will use up to date technology that will help us to do this.
10.4. Ardhi will always comply with our obligation under the applicable laws.
11. TRANSFER OF PERSONAL INFORMATION
11.1. Ardhi is based in and operate from the Republic of South Africa.
11.2. Your information, including personal information, may be transferred to and maintained on servers located outside of your country of residence, where the data privacy laws, regulations and standards, may not be equivalent to the laws in your country of residence.
11.3. Ardhi might transfer your personal information to places outside of South Africa and store it there, where our suppliers might process it. If that happens, your personal information will only be transferred to and stored in country that has equivalent, or better, data protection legislation than the Republic of South Africa or with a service provider which is subject to an agreement requiring it to comply with data protection requirements equivalent or better than those applicable in the Republic of South Africa. Your use of Ardhi’s website, followed by your submission of information to us, represents your consent to such transfer.
11.4. Ardhi will take all steps reasonably necessary to ensure that your personal information is treated securely and in accordance with this privacy policy.
12. LINKS TO OTHER WEBSITES
12.1. Ardhi’s website or social media platforms may contain links to and from websites, mobile applications or services of third parties, advertisers or affiliates. Please note that Ardhi is not responsible for the privacy practices of such other parties and advise you to read the privacy statements of each website you visit which collects personal information.
13. CHANGES TO THIS PRIVACY POLICY
13.1. Ardhi may update this privacy policy from time to time. Any changes that we may make to our privacy policy will be posted on our website and will be effective from the date of posting. It is your responsibility to check the website often for updates and changes to the policies.
14. ACCESS TO YOUR PERSONAL INFORMATION
14.1. You may at any time request:
14.1.1. confirmation that Ardhi holds your personal information;
14.1.2. access to your personal information;
14.1.3. the identities or categories of third parties to whom Ardhi has disclosed your personal information to; or
14.1.4. that Ardhi correct or delete any personal information that is incomplete, misleading, inaccurate, excessive or out of date.

ACCESS TO INFORMATION MANUAL
OF
ARDHI DÉCOR
IN TERMS OF SECTION 51 OF THE PROMOTION OF ACCESS TO INFORMATION ACT 2 OF 2000, AS AMENDED (“PAIA”)

1. INTRODUCTION
1.1. This manual has been prepared in accordance with section 51 of PAIA.
1.2. The aim of this manual is to assist potential requestors with the procedures to be followed when requesting access to information and/or documents from Ardhi Décor as contemplated in terms of PAIA.
1.3. Any requestor is advised to contact the Information Officer should assistance be required in respect of utilizing this manual to request information and/or documents.
1.4. Daniel Jacobus Robbertse has been duly appointed as the Information Officer for Ardhi Décor and is the person to whom requests for access to information must be made in terms of PAIA and in terms of the Protection of Personal Information Act 4 of 2013 (“POPIA”).
1.5. This manual may be amended from time to time and as soon as amendments have been effected, the latest version of the manual will be published and distributed in accordance with PAIA and POPIA.
2. DEFINITIONS
The following words and expressions shall bear the meanings assigned to them in this manual:
2.1. “PAIA” shall mean the Promotion of Access to Information Act, 2 of 2000, as amended, together with any relevant regulations published;
2.2. Ardhi” shall mean Ardhi Décor;
2.3. “Client” and/or “Customer” shall mean a natural or juristic person who or which receives services from Ardhi;
2.4. “Employee” shall mean any person who works for, or provides a service to, or on behalf of Ardhi, and receives or is entitled to receive remuneration;
2.5. “Information Officer” shall mean the designated information officer/s or the head of the body as described in this Manual;
2.6. “Information Regulator” shall mean the Information Regulator (South Africa);
2.7. “Manual” shall mean this manual together with any appendices thereto as available at the offices of Ardhi from time to time;
2.8. “Requestor” shall mean any person or entity requesting access to a record that is under the control of Ardhi;
2.9. “SAHRC” shall mean the South African Human Rights Commission

4. OVERVIEW OF ARDHI
4.1. Ardhi manufactures and supplies handmade and imported décor products, including but not limited to lighting like table and floor lamps, pendants, tables, chairs and light bulbs.
5. GUIDE ON HOW TO USE PAIA
5.1. The SAHRC compiled a guide on how to use PAIA (“the Guide”).
5.2. From 1 July 2021, the Information Regulator assumed the functions of the SAHRC. Accordingly, the Information Regulator has in terms of Section 10(1) of PAIA updated and made available the Guide compiled by the SAHRC, in an easily comprehensible form and manner as may be reasonably required by a person who wishes to exercise any right contemplated by PAIA or POPIA. The Guide is available for inspection a the offices of the Information Regulator and on its website (https://inforegulator.org.za/). Copies of the Guide (in English and Afrikaans languages) are also available for inspection at Ardhi’s offices during normal working hours. Where applicable and insofar as the Requester complies with the requirements set out in the relevant act, the Requester may request information which is available in terms of the following legislation :

9. REQUEST PROCEDURES
9.1. A request for access to a record in terms of PAIA must substantially correspondent with Form 2 of Annexure A to the Regulations Relating to the Promotion of Access to Information Act 2021; alternatively access the request form on https://informationregulator.org.za/paia-forms/. The Request must be made to the Information Officer. The request must be made to the address, fax number or electronic email address of the Information Officer.
9.2. The requester must provide sufficient detail on the request form to enable the Information Officer to identify the record and the requester. The requester should also indicate which form of access is required. The requester should also indicate if it requires notice of the decision of the Information Officer in any manner, other than in writing and state the particulars to be so informed.
9.3. The requester must identify the right that is sought to be exercised or to be protected and provide an explanation of why the requested record is required for the exercise or protection of that right.
9.4. If a request is made on behalf of another person, the requester must submit proof of the capacity in which the requester is making the request to the satisfaction of the Information Officer.
10. FEES
10.1. A requester who seeks access to a record containing personal information about that requester is not required to pay the request fee. Every other requester, who is not a personal requester, must pay the required request fee.
10.2. The Information Officer must by notice, require the requester to pay the prescribed fee, if any, before further processing the request.
10.3. The requester may lodge an application to court against the tender or payment of the request fee.
10.4. After the Information Officer has made a decision on the request, the requester must be notified in the required form.
10.5. If the request is granted then a further access fee must be paid for the search, reproduction, preparation and for any time, in excess of the prescribed hours, required to search and prepare the record for disclosure.
11. GROUNDS FOR REFUSAL OF ACCESS
11.1. In terms of Part 3, Chapter 4 of PAIA, Ardhi may and in certain instances refuse access to records on the grounds set out in PAIA. The grounds include, but are not limited to:
11.1.1. professional privilege
11.1.2. that the record constitutes privileged information for the purposes of legal proceedings
11.1.3. that it is necessary to protect the commercial information or the confidential information of a third party’ that it is necessary to protect the commercial information of Ardhi
11.1.4. that it is necessary to protect the safety of individuals or property
11.1.5. that it is necessary to protect the research information of a third party or of Ardhi; and
11.1.6. that granting access would result in unreasonable disclosure of personal information about a third party.
12. RECORDS OR INFORMATION NOT FOUND
12.1. If, after all reasonable steps to locate a record have been taken and no record is found, then the Information Officer will notify the requester, by way of an affirmation or affidavit that access to the requested and titled document cannot be provided. The affirmation or affidavit will include detailed account of the steps taken to try and locate the record.
12.2. Should a record be found at a later stage, the Information Officer shall provide the requester access to such record, unless access to the record is refused on the grounds permitted by PAIA (Part 3, Chapter 4).
13. OTHER INFORMATION HELD BY ARDHI AS PRESCRIBED
13.1. The Minister of Justice and Constitutional Development has to date not made any regulations regarding disclosure of other information.
14. AVAILABILITY OF THE MANUAL
14.1. This Manual is available for inspection by the general public upon request, during office hours and free of charge, at the offices of Ardhi. Copies of the Manual are also avalable on Ardhi’s website, www.ardhi.co.za.
